1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the game application SQUISH! ("the App"), provided by Amazing engine Co., Ltd. ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be old enough to form a binding contract in your jurisdiction to use the App. If you are a minor, you may use the App only with the consent and supervision of a parent or legal guardian. The App complies with the age requirements of the platform through which it is distributed.

3. License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial entertainment. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except where such restriction is prohibited by law.

4. Prohibited Conduct

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• cheat, exploit bugs, use unauthorized third-party software, bots, or modifications;
• interfere with or disrupt the App, its servers, or networks;
• harass, abuse, or harm other users;
• attempt to gain unauthorized access to any part of the App or related systems.

5. In-App Purchases and Virtual Items

The App may offer in-app purchases and virtual items or currency. Virtual items have no real-world monetary value, are non-transferable, and are non-refundable except as required by applicable law or the policies of the distribution platform. All purchases are processed by the platform operator, and the platform's payment and refund policies apply.

6. User Content

If the App allows you to submit content (e.g. names, messages, or shared creations), you retain ownership of your content but grant us a worldwide, royalty-free license to use, host, and display it for the purpose of operating the App. You are solely responsible for the content you submit.

7. Intellectual Property

The App, including its code, graphics, audio, characters, and design, is owned by us or our licensors and is protected by intellectual property laws. All rights not expressly granted to you are reserved.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. You may stop using the App at any time.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced within the App or on our official channels. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts having jurisdiction over our head office location.

1. 規約への同意

本利用規約（以下「本規約」）は、Amazing engine株式会社（以下「当社」）が提供するゲームアプリケーション SQUISH!（以下「本アプリ」）の利用に関する条件を定めるものです。本アプリをダウンロード、インストール、または利用した時点で、利用者は本規約に同意したものとみなされます。同意いただけない場合は、本アプリを利用しないでください。

2. 利用資格

本アプリを利用するには、利用者が居住する地域の法令上、有効に契約を締結できる年齢に達している必要があります。未成年者は、親権者または法定後見人の同意および監督のもとでのみ本アプリを利用できます。本アプリは、配信プラットフォームが定める年齢要件を遵守します。

3. 利用許諾

当社は利用者に対し、個人的かつ非営利の娯楽目的に限り、本アプリを利用するための譲渡不能・非独占的・取消可能な利用権を許諾します。利用者は、法令で禁止が認められない範囲を除き、本アプリの複製、改変、配布、販売、貸与、リバースエンジニアリング、ソースコードの抽出を行ってはなりません。

4. 禁止事項

利用者は、以下の行為を行わないものとします。

• 違法な目的、または本規約に違反する目的での本アプリの利用
• チート、バグの悪用、未承認の第三者ソフトウェア・ボット・改造ツールの使用
• 本アプリ、そのサーバーまたはネットワークへの妨害・支障を与える行為
• 他の利用者への嫌がらせ、誹謗中傷、加害行為
• 本アプリまたは関連システムへの不正アクセスの試み

5. アプリ内課金および仮想アイテム

本アプリは、アプリ内課金や仮想アイテム・仮想通貨を提供する場合があります。仮想アイテムは現実の金銭的価値を持たず、譲渡不可であり、適用される法令または配信プラットフォームのポリシーで定められる場合を除き、返金されません。すべての購入はプラットフォーム運営者によって処理され、当該プラットフォームの決済・返金ポリシーが適用されます。

6. ユーザーコンテンツ

本アプリが利用者によるコンテンツ（名前、メッセージ、共有される作成物など）の投稿を許可する場合、当該コンテンツの権利は利用者に帰属しますが、利用者は当社に対し、本アプリの運営目的で当該コンテンツを利用・保存・表示するための、全世界・無償の利用許諾を付与するものとします。投稿したコンテンツについては利用者が単独で責任を負います。

7. 知的財産権

本アプリ（コード、グラフィック、音声、キャラクター、デザインを含む）に関する権利は、当社または当社にライセンスを許諾する者に帰属し、知的財産法によって保護されています。利用者に明示的に許諾されていない一切の権利は留保されます。

8. 免責事項

本アプリは「現状有姿」かつ「提供可能な範囲」で提供され、特定目的への適合性および非侵害を含む、明示・黙示を問わずいかなる保証も行いません。当社は、本アプリが中断なく、またはエラーなく動作することを保証しません。

9. 責任の制限

法令で認められる最大限の範囲において、当社は、利用者による本アプリの利用または利用不能から生じる間接的・付随的・特別・結果的または懲罰的損害について、一切の責任を負いません。

10. 利用の停止・終了

利用者が本規約に違反した場合、または当社が本アプリの提供を終了する場合、当社は事前の通知の有無に関わらず、いつでも本アプリへのアクセスを停止または終了できます。利用者はいつでも本アプリの利用を中止できます。

11. 本規約の変更

当社は、本規約を随時改定することがあります。重要な変更については、本アプリ内または当社の公式チャネルにて告知します。変更の発効後も本アプリの利用を継続した場合、改定後の規約に同意したものとみなされます。

12. 準拠法および管轄

本規約は、抵触法の原則にかかわらず、日本法に準拠します。本アプリに関する紛争については、当社の本店所在地を管轄する裁判所を専属的合意管轄裁判所とします。
